Zomato, responding to stock exchange queries, stated it would “promptly comply” with any recommendations from the Competition Commission of India (CCI) regarding allegations of violating antitrust provisions in food delivery.
Zomato stated it will work closely with the CCI to explain its practices comply with the Competition Act and do not harm competition in India.
Swiggy, still awaiting CCI’s confidential findings, said the investigation is preliminary and has not yet decided. The company is cooperating fully and committed to complying with Indian laws.
A CCI probe found that Zomato and Swiggy may have violated antitrust norms by forming exclusive arrangements with restaurant partners.
Both firms were accused of pressuring restaurant partners to maintain price parity and prevent offering lower prices on rival platforms.
The investigation followed a 2022 CCI order that identified potential antitrust violations, leading to a detailed probe. The CCI is reviewing the report and will decide in a few weeks.
The NRAI approached the Delhi High Court to access the full investigation report from CCI’s director general after receiving a “redacted” report in March.
CCI redacts reports to protect the trade secrets of companies involved in the investigation.
The NRAI’s earlier attempt in Karnataka to access the full report was unsuccessful, as the Karnataka High Court ruled that NRAI was not an aggrieved party.
A non-confidential version of the report has been shared with Zomato and Swiggy.
