Ride-Sharing Platform Gets Relief as Delhi HC Stays on Transport Department’s Notice

In a major relief to Ola, Uber and Rapido, the Delhi High Court on Friday stayed the public notice and show-cause notices issued by the city’s Transport Department to stop the ride-sharing platforms.

A division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna directed the Transport Department to refrain from any enforcement action against Rapido and other ride-sharing platforms until a comprehensive policy is in place.

In February, app-based aggregators were banned from running on the road without a commercial permit.

The Transport Department ordered the immediate cessation of bicycle taxi services provided by these platforms and warned that any violations would be punished.

Companies violating the order will be fined up to Rs 1 lakh, as using bikes for commercial purposes is an offence under the Motor Vehicles Act, 1988, the Transport Department’s public notice said.

Following the High Court ruling, Uber is thankful for a court order that protects the company from coercive practices by bike taxi services in the capital city.

“We welcome the High Court’s order protecting Uber from enforcement action against Delhi bike taxis. This will bring relief to drivers on our platform whose livelihoods have been affected by the ban, and relief to the thousands of riders who choose to ride Delivering affordability and last-mile connectivity on Moto. We are committed to serving cities and being the platform of choice for riders and drivers,” Uber said in a statement.
