The Finance Ministry clarified that not all residents leaving India need tax clearance certificates. This requirement applies only to specific cases under the Income Tax Act 1961.
The Ministry stated that individuals must only obtain a tax clearance certificate if they are involved in serious financial irregularities and must be present for investigation or have unpaid direct taxes exceeding Rs 10 lakh.
The Budget for 2024-25 introduced amendments regarding the necessity of obtaining tax clearances for those planning to move abroad from India.
The Finance Ministry emphasised that the requirement for a no-liabilities clearance certificate under the Black Money Act 2015 would apply differently to residents and non-residents.
Additionally, the Ministry mentioned that the decision to request a tax clearance certificate would require approval from the appropriate tax authorities after recording the reasons for the request.
